Oklahoma rules for construction & trades
- State income tax (2026)
- Oklahoma has a graduated state income tax for 2026: 0% to 4.5% (top rate starts at $7,200 for single filers). HB 2764 (2025) cut the top rate from 4.75% to 4.5% for tax year 2026 and replaced the old six-rate schedule with a 0% band plus three rates. Single filers: 0% on the first $3,750 of taxable income, 2.5% on the next $1,150, 3.5% on the next $2,300, and 4.5% above $7,200 (joint filers: double the bracket widths). Further 0.25-point cuts happen only if the State Board of Equalization certifies enough revenue growth; any cut takes effect the January 1 after the February certification.
- State estimated tax
- You must pay quarterly if you expect your tax to exceed withholding by $500 or more and withholding to be less than the smaller of 70% of this year's tax or 100% of last year's tax; no underpayment interest applies if the tax on your return is under $1,000. Same dates as federal (April 15, June 15, September 15, January 15) Form OW-8-ES.
- Independent Driver Classification Act (HB 2464, 2023)
- Rideshare (TNC) drivers are independent contractors, not employees, if the company sets no required login hours, does not bar them from other apps or other work, and both sides agree in writing that the driver is a contractor. Effective November 1, 2023.
Federal rules for 2026
W-2 or 1099 changes everything
On a W-2 your employer withholds tax and may offer a retirement plan. As a 1099 subcontractor you pay self-employment tax and quarterly estimates, but you can deduct tools, materials and job-site driving.
Tools and equipment
Tools, equipment, safety gear and work vehicles used for business are deductible; larger purchases can often be written off in the year you buy them.
Overtime deduction for W-2 workers
Non-exempt W-2 workers can deduct the overtime premium they are paid, up to $12,500 a year ($25,000 joint) from 2025 through 2028, subject to an income phase-out.
Quarterly estimated taxes
No one withholds tax from self-employment income, so you generally pay estimates four times a year if you expect to owe $1,000 or more. For 2026 income the federal dates are April 15, June 15 and September 15, 2026, and January 15, 2027. Paying 100% of last year's tax (110% if your AGI was over $150,000) in four equal installments avoids the underpayment penalty.
A worked example
