State income tax (2026)
Pennsylvania has a flat 3.07% state income tax for 2026. Flat 3.07% applies to eight separate classes of income, including net business profits. A loss in one class cannot offset income in another class.
State estimated tax
For 2026, you must pay estimated tax if you expect to owe at least $430 ($14,000 of income not subject to withholding) after withholding and credits; the income threshold rises to $17,000 in 2027 and $20,000 in 2028. Same dates as federal (April 15, 2026; June 15, 2026; September 15, 2026; January 15, 2027) Form PA-40 ES (I) with worksheet REV-414 (I).
Minimum wage (2026)
$7.25 an hour; tipped cash wage $2.83 an hour. A tipped employee is one who regularly gets more than $135 a month in tips. Cash wage plus tips must reach at least $7.25 an hour. No increase was in effect as of July 1, 2026, according to the USDOL state table.
Unemployment compensation two-part independent contractor test
A worker is presumed to be an employee unless they are free from control or direction over the work, both under the contract and in fact, and are customarily engaged in an independently established trade, occupation, profession, or business.
Construction Workplace Misclassification Act (Act 72 of 2010)
Construction workers are presumed to be employees. To be a contractor they need a written contract, freedom from control, and an independent business. That includes owning essential tools, chance of profit or loss, a separate business location, work for others, and at least $50,000 of liability insurance.

Federal rules for 2026

No tax on tips (2025 to 2028)

Eligible workers in occupations that customarily receive tips can deduct up to $25,000 of qualified tips a year from federal taxable income, whether or not they itemize. The deduction shrinks for modified AGI over $150,000 ($300,000 joint). It is income tax only: Social Security and Medicare still apply to tips.

Tips must be reported

Employees must report cash tips of $20 or more in a month to their employer by the 10th of the next month. Tips you did not report go on Form 4137. Only reported tips count toward the deduction.

Overtime deduction

W-2 workers who are owed overtime under federal law can also deduct the overtime premium, up to $12,500 a year ($25,000 joint), with the same income phase-out.

Roth IRA

Without a workplace plan, a Roth IRA lets you save up to $7,500 in 2026 ($8,600 at 50 or older) and withdraw qualified money tax-free in retirement, subject to income limits.
