W-2 or 1099?

Aides placed by home care agencies are usually W-2 employees with taxes withheld. Caregivers hired directly by a family are often the family's household employee, while independent caregivers with their own clients may be self-employed and file Schedule C.

Overtime deduction for agency aides

Home care agencies must pay federal overtime, so agency aides can deduct the premium half of time-and-a-half, up to $12,500 ($25,000 joint), phasing out above $150,000 MAGI ($300,000 joint). Aides employed directly by a family may be exempt under companionship rules.

Miles between client homes

Self-employed caregivers can deduct business miles at 72.5 cents (Jan–Jun 2026) or 76 cents (Jul–Dec 2026). W-2 employees generally can't deduct unreimbursed work miles on their federal return.

Independent caregivers pay quarterly

With no withholding, you may need 2026 estimates on April 15, June 15 and Sept. 15, 2026, and Jan. 15, 2027. Self-employment tax is 15.3% on 92.35% of net profit.

Retirement options

Use an agency 401(k) if offered (up to $24,500 in 2026, more with catch-ups) and an IRA up to $7,500. Self-employed caregivers can open a SEP IRA or Solo 401(k).

Does the no-tax-on-overtime deduction apply to me?+

Only if you're overtime-eligible under the federal FLSA, and only for the premium portion federal law requires. Agency-employed aides generally are; companionship workers hired directly by a family may not be. Overtime paid only under state law or agency policy doesn't qualify.

A family pays me directly to care for their parent. Am I self-employed?+

Often not. If the family controls what work you do and how, the IRS usually treats you as their household employee, and they handle payroll taxes once wages pass the annual threshold.

Can I deduct scrubs, CPR classes or supplies?+

If you're self-employed, ordinary and necessary business costs are deductible on Schedule C. W-2 employees generally cannot deduct unreimbursed job expenses federally.

Can caregivers use the tips deduction?+

Personal care aides and elderly companions are on the IRS tipped occupation list (code 501), so voluntary tips can qualify, up to $25,000. Tips don't qualify if you or your employer is in a specified service business such as health, so medical home health work may be excluded.
